Westside Rentals Gets an "F"

WestLAOnline reports that Westside Rentals - the city's biggest local housing-rental listings agency - just earned an "F" rating from the Better Business Bureau.
The reason(s)? Westside Rentals lies in its listings, according to a summary of customer complaints filed with the BBB.
Furthermore, the agency violates California law by charging people $60 to use its listings for 60 days, the report says.

California law requires companies offering rental listings to enter into a contract with you before accepting their fee from you, and the contract is subject to certain requirements. First, it must expire no longer than 90 days from the time you execute it. It must include, besides specifically what you are seeking in a property, a provision for refunding anything you paid over $50 to you if you obtain a rental elsewhere and a provision for refund if they do not provide you at least three available rentals meeting your specifications within five days after you paid your fee. It must also outline the small claims court remedy that is available to you. This means that if you pay a total of $60, use the service for longer than 5 days, if contractural obligations were fullfilled, you would be eligible for a refund of $10.

"Most complainants allege the company misrepresents the availability, condition, amenities and pricing of listed properties, and they encounter difficulties obtaining refunds. Other customers complain landlords they contact allegedly disclose they had advertised thier property in the local newspaper, and had not given the company authorization to list thier property. The company responds in some cases by disputing allegations, offering explanations, issuing refunds, or partial refunds. In some cases customers dispute that refunds were actually received. Some responses did not address the complainants allegations and were returned to the company for further consideration." (No indication why the third sentence in the first paragraph after the break suddenly ends after "complainants" on the report card.)
What's more, BBB reports Westside Rentals is operating under a probationary real estate license, as the result of "an administrative action rendered by the Department of Real Estate."
What's odd is that the BBB report card then says, We know of no government action taken against this company. ... and:No question about the truth of this company's advertising has come to our attention. Well, which is it, folks?
